Settlement – Indefinite Leave to remain as a refugee or Humanitarian Protection Set(P)
A guide for those granted refugee status or humanitarian protection and who have now completed 5 years residence in the UK.
Eligibility Requirements
- The applicant must have held refugee leave to remain or humanitarian protection in the UK for a continuous period of 5 years and the circumstances that led to the grant of status in the UK are still relevant
- The applicants residence permit must not have been revoked or not renewe
- The applicant must not:
- Have been convicted of an offence that lead to 4 years or more imprisonment
- Have been convicted of an offence that lead to 12 months – 4 years imprisonment, unless 15 years has passed since the sentence ended
- Have been convicted of an offence that lead to less than 12 months imprisonment, unless 7 years has passed since the sentence ended
- In the 24 months prior to the application have been decided, convicted of or admitted to an offence for which they have received a non-custodial sentence or other out of court disposal that is recorded on their criminal record.
- In the view of the Secretary of State caused serious harm by their offending or persistent offending and shown a particular disregard for the law.
Supporting Documents
- Any current or expired passports for the applicants
- Any travel documents that have been issued
- Any National Identity Cards
- Current Biometric Residence Permit
- Birth certificates for child dependents on application
- Each applicants signed declaration form
- Evidence of any previous visa refusals etc.
- Tenancy Agreement
- Any time you have spent outside the UK
- Evidence you have established a life in the UK (work, hobbies, etc.)
- Marriage certificates
- Previous determination letter
- Correspondence at your current address
- Evidence of continued reasons for claiming asylum
