Registration – A Child born abroad to British parents
A guide for those seeking the registration of their child as a British Citizen where that child was born outside of the UK
Requirements
- Was born outside of the UK or any of the British Overseas Territories
- Born to one of both parents who are British Citizens by decent
Section 3(5)
- The child and their parents should have been physically present in the UK for at least the three year period, prior to the date the application is received. The child and their parent must not have been absent from the UK longer than 270 days during this 3 year period
- If the child’s parents’ marriage or civil partnership has ended or they are legally separated, then only the child and one parent needs to satisfy the residence requirement
- Both parents must consent to the child being registered as a British Citizen. If one of the parents has died, then consent is only needed from the surviving parent
Section 3(2)
- The mother or father of the child’s parent (the child’s grandparent) became, or but for their death would have become a British Citizen otherwise than by decent, either:
- On 1st January 1983
- At the time of the parents birth
- The parent who is British by decent must have lived in the UK for a continuous period of 3 years at any point before the child’s birth and should not have been absent for a period exceeding 270 days in this time.

- Signed parents consent form
- Copy of parents passports
- 2x referee pages for applicant and passport photo
- Applicant’s Passport
- Parents employment information
- Evidence of child’s schooling
- Proof of residency either for the 3 years prior to the application under section 3(5) or for the 3 year period of residency if under section 3(2)
- Parents marriage certificate
- Parents divorce certificate (if applicable)
- Child’s grandparent’s birth certificate if under Section 3(2)
