Settlement – Indefinite Leave to remain as a partner Set(M)
A guide for those wishing to apply for indefinite leave to remain after completing 5 years residence in the UK as the spouse of a British Citizen or a person who is present and settled in the UK.
Relationship Requirements
- You must demonstrate that you and your partner are currently living together in the UK.
- You and your partner must both be aged 18 or over and must not have been related in the prohibited degree prior to your marriage.
- You and your partner must continue to have a genuine and subsisting relationship.
- You must obtain B1 level English Language
- You must pass the life in the UK test
- You must be able to meet the financial requirement
You must not
- Be subject to a deportation order
- Have been convicted of an criminal offence in the UK where you have received a sentence of 4 years of more
- Have been convicted of an criminal offence in the UK where you have received a sentence of between 12 months and 4 years and less than 15 years has passed since the end of your sentence.
- Have been convicted of an criminal offence in the UK where you have received a sentence of less than 12 months unless a period of 7 years has passed since the end of your sentence
- Have been convicted of a non custodial sentence or out of court disposal in the last 24 months
- Be someone who’s character or conduct makes their presence in the UK makes it undesirable to allow them to remain
- Be someone who has used false information or made false representations or documents in support of the application
- Be someone who has failed to declare a material fact in relation to the application

- Attend any requested interview during your application
- Provide required information
- Provide physical data (biometrics)
